Terms & Conditions
1. About us
This website is run by Joy Thorpe Antiques, The Commercial Establishment, Kilkenny Street, Castlecomer, Co. Kilkenny, R95 CK77, Ireland. You can contact us at enquiries@joythorpeantiques.com or on 086 8960791 (+353 86 896 0791).
2. These terms
These terms apply to all orders placed on www.joythorpeantiques.com. Please read them before you order. By placing an order, you agree to these terms. Nothing in these terms affects your statutory rights as a consumer.
3. Your order
After you place an order, we will email you to confirm we have received it. Your order is accepted, and a contract formed, when we email you to confirm it has been dispatched.
Most of our items are one of a kind. If an item turns out to be unavailable, or if we have made an obvious error in its price or description, we will contact you and give you a full refund if you no longer wish to proceed.
4. Prices and payment
All prices are in euro (€) and include any Irish VAT that applies. Delivery charges for smaller items are shown at checkout before you pay. Delivery for furniture and other large items is quoted separately (see section 7). Prices do not include import VAT, customs duties, taxes or courier charges for orders sent outside Ireland (see section 8).
5. Description and condition of items
We sell antique, vintage and decorative items, and we describe each one as fully and accurately as we can. We provide photographs from several angles and measurements.
Antique and vintage items are not in new condition. Most will show signs of age and use, such as marks, scratches, wear or repairs, which form part of their character and history. Signs of age that are described or visible in the photographs are not faults. Colours may vary slightly between screens. If you would like more photographs or information before you buy, please contact us.
6. Electrical items
We strongly recommend that any vintage electrical item is inspected, tested and installed by a qualified electrician before use, and is protected by an RCD.
7. Delivery
Smaller items. Smaller items are usually dispatched within 3-4 working days of your order, fully insured and with tracking, by our courier or An Post. The delivery charge is a flat rate for your country and is shown at checkout. It is the same whether you order one small item or several. Some items, such as pre-orders, have a longer dispatch time, which is shown on the product page.
Furniture and large items. Delivery for furniture and other large items is not charged at checkout. Checkout shows "Delivery quoted separately - we'll be in touch". After you order, we will contact you with a delivery quote for your address. We usually arrange furniture delivery within 7-14 working days wherever possible. Once you accept the quote, our courier will contact you directly to arrange a delivery time, and the delivery charge is paid to the driver on delivery. If you do not wish to accept the quote, we will cancel your order and refund you in full, including the price of the item.
Orders with both. If your order includes a large item, we will quote delivery for the whole order together.
Collection. You are also welcome to collect your purchase from our shop in Castlecomer.
Risk. Items remain at our risk until they are delivered to you or to someone you have nominated. If an item arrives damaged, please contact us as soon as possible with photographs, and keep the packaging. This does not affect your statutory rights.
8. International orders, import duties and taxes
We send worldwide, including to Australia and New Zealand. International parcels are sent fully insured and with tracking, by An Post or our courier. Delivery times vary by destination and may be affected by customs. Parcels sent outside the EU need a customs declaration, which we complete for you.
Please note that orders sent outside Ireland may be subject to local import VAT, customs duties, taxes or courier charges on arrival. These charges are set by the destination country and are the responsibility of the customer. They are not included in the item price or delivery charge. We cannot predict what they will be, so please check with your local customs office before ordering.
We declare all items at their full value, as the law requires. We cannot mark items as gifts or declare a lower value.
If you refuse to pay these charges and the parcel is returned to us, we will treat this as a cancellation under section 9. We will refund the price of the item and the standard delivery charge, minus the cost of returning the parcel to us. Depending on the country, you may be able to reclaim import VAT on returned goods from your local tax authority.
9. Your right to cancel (online orders)
If you buy online, you may cancel your order for any reason within 14 days of the day you, or someone you nominate, receive the item.
- Tell us. Email us at enquiries@joythorpeantiques.com with your order number, or use the cancellation form below. You do not have to give a reason.
- Return the item. Send it back within 14 days of telling us, well packed and insured, to the address in section 1. You must pay the cost of returning it. For large or heavy items that cannot be posted, we will tell you the likely return cost before you arrange it, and we are happy to help arrange this.
- Your refund. We will refund the price of the item, less a restocking fee of 10% of the item price, and the delivery charge you paid within 14 days of the day you tell us you wish to cancel. We may wait until we have received the item back, or you have shown us proof that you have sent it, whichever is sooner. If you chose a more expensive delivery option than the standard one, we only refund the cost of standard delivery. For furniture delivered on a separate quote, we refund the delivery charge up to the cheapest option we offered. Refunds are made to your original payment method.
The restocking fee does not apply to orders cancelled before they are dispatched, to faulty or misdescribed items (see section 10), or to orders we cancel because you do not accept a delivery quote.
Please take care of the item while it is with you. We may reduce your refund if the item has been damaged, or has lost value because it was handled more than needed to examine it, as you would in a shop.
The right to cancel does not apply to items made or altered to your own specifications, such as special orders where an item has been modified at your request.
10. Faulty or misdescribed items
If an item is faulty or not as described, you have legal rights under the Consumer Rights Act 2022. Please contact us as soon as possible. Because most of our items are one of a kind, we will usually offer a full refund, including delivery and reasonable return costs, or where appropriate a price reduction, rather than a replacement. These rights are in addition to your right to cancel.
11. Purchases in our shop
Items bought in person at our Castlecomer shop can be inspected before purchase, so we do not offer refunds if you change your mind. This does not affect your rights if an item is faulty or not as described.
12. Our liability
If we fail to meet these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure. We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence.
13. Your personal information
We use your personal information only as set out in our Privacy Policy.
14. Complaints
If you have a problem, please contact us first and we will do our best to put it right. You can find more information about your consumer rights from the Competition and Consumer Protection Commission (ccpc.ie).
15. Law
These terms are governed by Irish law, and disputes may be brought in the Irish courts. If you live elsewhere, you keep any protections given to you by the mandatory laws of the country where you live.
16. Changes to these terms
We may update these terms from time to time. The terms that apply to your order are the ones shown on the website when you placed it.
